1. Acceptance of Terms

By accessing or using Aeralis (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Aeralis is a Google Workspace Add-on that provides AI-powered email composition and reply generation services. The Service uses Google Gemini AI to generate email drafts based on user input and context.

Features include:

• AI-generated email drafts and replies
• Custom system prompts and tone preferences
• Google Search grounding for up-to-date information
• Google Maps integration for location-aware responses
• Knowledge capability for document context (Business tier)
• Context URLs for additional reference material
• Thread understanding for contextual replies

3. User Accounts and Authentication

To use the Service, you must have a valid Google account and grant the necessary permissions for the Add-on to function. You are responsible for maintaining the security of your account credentials.

OAuth Scopes and Justification:

Aeralis requests only the minimum necessary permissions (OAuth scopes) required to provide the Service. We use the narrowest scopes possible to respect your privacy and data security.

Why These Permissions Are Necessary: Each scope listed above is essential for core functionality. We cannot generate contextual email drafts without access to email metadata, and we cannot insert drafts into Gmail without compose permissions. The Service will not function without these permissions.

4. Subscription Plans and Payment

Aeralis offers the following subscription tiers:

Pro and Business plans include a 7-day free trial period. A valid credit card is required to start the trial. After the trial period ends, subscription fees are billed monthly in advance. You may cancel your subscription at any time during or after the trial, and cancellation will take effect at the end of the current billing period.

All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle is responsible for processing your payment and providing customer service inquiries related to payments.

5. Refund Policy

To request a refund, please contact us at support@aeralis.ai with your account email. We will process refund requests within 5-10 business days.

All payments are processed through Paddle.com Market Limited ("Paddle"), our Merchant of Record. Refunds will be issued by Paddle to your original payment method. The timing of when refunded funds appear in your account depends on your payment provider.

If you cancel during your free trial period, you will not be charged.

6. Usage Limits and Fair Use

Each subscription tier includes a monthly limit on AI-generated emails. Unused emails do not roll over to the next month. We reserve the right to enforce fair use policies and suspend accounts that abuse the Service or attempt to circumvent usage limits.

7. Privacy and Data Collection

We are committed to protecting your privacy. Our data collection and usage practices are detailed in our Privacy Policy.

Key privacy principles:

• We do not store email content unless you explicitly provide negative feedback
• Authentication is handled securely through Google OAuth
• We collect usage metadata to improve the Service
• Your system prompts and preferences are stored securely in Firebase

8. Acceptable Use Policy

You agree not to use the Service to:

• Generate spam, phishing emails, or malicious content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to the Service or related systems
• Reverse engineer or attempt to extract the source code

9. AI-Generated Content

The Service uses artificial intelligence to generate email content. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
• You are responsible for reviewing and editing all AI-generated content before sending
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content
• You retain full responsibility for all emails sent using the Service

10. Intellectual Property

The Service, including its design, functionality, and underlying technology, is owned by Aeralis and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

Content you generate using the Service belongs to you, subject to our Privacy Policy regarding data collection for Service improvement.

11. Third-Party Services

The Service integrates with third-party services including:

• Google Gemini AI for content generation
• Google Gmail API for email management
• Google Search for grounding
• Google Maps for location data
• Firebase for data storage and authentication

Use of these third-party services is subject to their respective terms of service and privacy policies.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by canceling your subscription and uninstalling the Add-on.

Upon termination, your right to use the Service will immediately cease, and we may delete your data according to our data retention policies.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Aeralis operates, without regard to conflict of law principles.
